Terms of Service

These Terms of Service ("Terms") govern your use of the Callvoa AI receptionist service ("Service") operated by Callvoa ("we," "us," or "our"), a sole proprietorship based in Dallas, Texas. By subscribing to or using the Service, you ("Customer," "you") agree to these Terms.

1. Service Description

Callvoa provides an AI-powered call answering service for home service contractors. The Service answers inbound phone calls on your behalf, captures caller information, detects urgency, schedules appointments on your calendar, and sends you notifications via SMS and/or email. The Service is AI-powered and does not guarantee human-identical call handling.

2. Free Trial

New customers receive a 30-day free trial beginning on the date of subscription. You will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid monthly subscription at the then-current rate ($297/month) unless you cancel before the trial ends. You may cancel at any time during the trial by emailing jackson@callvoa.com.

3. Billing and Payment

After your free trial, you will be billed monthly at the subscription rate on file. All payments are processed through Stripe. You authorize us to charge the payment method you provide on a recurring monthly basis. If a payment fails, we may retry the charge and/or suspend the Service until payment is received. All fees are in U.S. dollars.

4. Cancellation

You may cancel your subscription at any time by emailing jackson@callvoa.com. Cancellation takes effect at the end of your current billing period — you will not be charged again after cancellation. There are no cancellation fees, early termination fees, or penalties of any kind. We do not offer refunds for partial billing periods.

5. Setup and Configuration

We will configure your AI receptionist within 24 hours of signup, including building a custom call script based on the business information you provide. You are responsible for setting up call forwarding from your phone carrier to the number we assign. We will guide you through this process. Changes to your script, business hours, or service area can be requested at any time at no additional charge.

6. Call Recordings

The Service records all inbound calls handled by the AI receptionist. These recordings are stored and accessible to you. You are responsible for complying with all applicable federal, state, and local laws regarding call recording and disclosure in your jurisdiction. Texas is a one-party consent state, meaning only one party to the call needs to consent to the recording. We recommend including a brief disclosure in your AI greeting that calls may be recorded.

7. SMS Notifications

By subscribing to Callvoa, you consent to receive SMS notifications related to calls handled by your AI receptionist, including new call alerts, appointment confirmations, and urgent call notifications. Message frequency varies based on call volume. Msg & data rates may apply. You may opt out of SMS notifications at any time by replying STOP to any message. Reply HELP for support. Opting out of SMS notifications does not cancel your Callvoa subscription.

8. Data and Privacy

We collect and store caller information (name, phone number, reason for calling, appointment details) solely to provide the Service to you. We do not sell, share, or distribute your business data or your callers' data to any third parties. Call data is retained for the duration of your subscription. Upon cancellation, your data will be deleted within 30 days unless you request it sooner. For payment processing, we use Stripe, which handles your payment information under its own privacy policy.

9. Service Availability

We aim to provide 24/7/365 call answering availability. However, the Service may occasionally experience downtime due to system maintenance, third-party provider outages, or unforeseen technical issues. We do not guarantee 100% uptime. We will make reasonable efforts to notify you of any planned maintenance in advance. We are not liable for any lost business or revenue resulting from Service downtime.

10. Limitation of Liability

Callvoa is an AI-powered service and does not guarantee that every call will be handled perfectly. The AI may occasionally misinterpret caller intent, provide incorrect information, or fail to properly triage urgency. Callvoa is not liable for any lost revenue, missed appointments, miscommunications, or damages arising from the use of the Service. Our total liability to you shall not exceed the amount you have paid us in the 30 days preceding the event giving rise to the claim. The Service is provided "as is" without warranties of any kind, express or implied.

11. Your Responsibilities

You agree to provide accurate business information for your AI script (services offered, hours, service area). You are responsible for maintaining active call forwarding to the Service. You are responsible for responding to urgent call notifications in a timely manner. You agree not to use the Service for any unlawful purpose.

12. Modifications to Terms

We reserve the right to update these Terms at any time. If we make material changes, we will notify you via email at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Modifications to Service and Pricing

We reserve the right to modify the Service or adjust pricing at any time. Price changes will not affect your current billing period. We will provide at least 30 days notice before any price increase takes effect. You may cancel before the new price takes effect if you do not agree to the change.

14. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes arising from these Terms or the Service shall be resolved in the courts of Dallas County, Texas.
